Copyright & Intellectual Property Protection
1What Is Protected
The following elements are original works owned by Bisama Technologies, protected by copyright and, where applicable, trademark and trade secret law:
- All source code, including backend, frontend, and mobile components, together with their logic, algorithms, and database schema;
- The visual design system, layouts, user interface components, iconography, and user experience flows;
- The “Bisama POS” name, logo, wordmark, and associated brand identity;
- Technical documentation, onboarding materials, and internal knowledge base content;
- Proprietary business logic, including pricing engines, tax calculations, reporting formulas, and the multi-tenant architecture; and
- All future updates, patches, features, and derivative works built upon the Software.
2Ownership
Nothing in any subscription, license, or usage agreement transfers ownership of the Software, or any of its components, to a Tenant/Company, User, contractor, or third party. Any modifications, customisations, plugins, or integrations built for or requested by a Tenant/Company remain the property of Bisama Technologies, unless a separate written agreement expressly assigns those rights.
3Prohibited Conduct
Without the prior written authorisation of Bisama Technologies, no person or entity may do any of the following:
- Copy, clone, fork, or reproduce the Software's source code, design, or database structure, in whole or in part;
- Reverse engineer, decompile, disassemble, or attempt to extract the underlying logic or algorithms of the Software;
- Rebrand, white-label, resell, sublicense, or distribute the Software or any derivative of it;
- Scrape, mirror, or systematically extract data, layouts, or content from the Software;
- Use the “Bisama POS” name, logo, or brand assets in a manner likely to cause confusion, or to imply an endorsement, affiliation, or partnership that does not exist; or
- Engage former or current staff, contractors, or partners to recreate substantially similar functionality using confidential knowledge obtained through their engagement with Bisama.
4Trade Secrets and Confidential Information
Certain aspects of the Software, including its architecture, security mechanisms, pricing models, and internal processes, constitute trade secrets of Bisama Technologies. Any employee, contractor, partner, or Tenant/Company granted access to such information is bound by confidentiality obligations, and may not disclose, publish, or use that information outside the scope of their authorised engagement with Bisama, both during and after that engagement ends.
5Enforcement and Remedies
Bisama Technologies actively monitors for unauthorised use, cloning, or infringement of the Software. Where infringement is identified, Bisama reserves the right to pursue any or all of the following remedies:
- Cease-and-desist notice, demanding immediate removal of infringing material and cessation of the infringing activity;
- Takedown requests to hosting providers, domain registrars, application marketplaces, and platforms hosting infringing copies;
- Civil litigation before the courts of Ghana, seeking injunctive relief, damages, an account of profits, and full recovery of legal costs;
- Criminal referral to the Ghana Police Service (CID Cybercrime Unit) or the Ghana Cyber Security Authority, for offences under the Cybersecurity Act, 2020 (Act 1038) and the Electronic Transactions Act, 2008 (Act 772), including unauthorised access to computer systems and data theft; and
- International enforcement, where infringement occurs outside Ghana, through applicable treaties and the courts or authorities of the relevant jurisdiction.
Infringers may be held liable for statutory and actual damages, lost profits, and the full legal costs incurred by Bisama Technologies in enforcing its rights.
6Licensed Use
Legitimate access to the Software is available exclusively through an active, paid subscription, or a signed licensing or reseller agreement with Bisama Technologies. Any party interested in white-labeling, reselling, or integrating with Bisama POS must contact us to negotiate formal licensing terms before doing so.
7Reporting Infringement
If you become aware of any unauthorised copy, clone, or misuse of Bisama POS, including counterfeit versions, unauthorised resellers, or leaked source code, please report it immediately to info@bisamapos.com. Reports will be treated confidentially and investigated promptly.
8Trademark Notice
“Bisama POS” and the Bisama logo are trademarks of Bisama Technologies. All other trademarks, product names, and company names referenced within the Software are the property of their respective owners, and are used for identification purposes only.
